These Terms and Conditions govern your use of the Kelong Tides website and the charter services offered by Kelong Tides Pte. Ltd.. By making an enquiry, submitting a booking, or using our website, you agree to be bound by these terms. Please take time to read them carefully before proceeding.

1. Definitions
- "Company", "we", "us", "our" — Kelong Tides Pte. Ltd., registered in Singapore.
- "Service" — yacht charter experiences offered by the Company, including the Heritage Waterway Tour, Corporate Day Charter, and Multi-Day Team Retreat.
- "User", "you", "your" — any person who visits our website, submits an enquiry, or books a charter.
- "Booking Party" — the individual or organisation that completes and confirms a charter booking.
- "Guests" — all persons aboard the vessel during a charter.
- "Agreement" — these Terms and Conditions, together with any booking confirmation issued by us.

2. Acceptance of Terms
By using our website or making a booking, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are booking on behalf of a company or organisation, you confirm that you have authority to bind that entity. If you do not agree with any part of these terms, please do not use our website or services.
3. Our Services
Kelong Tides provides private yacht charter experiences departing from HarbourFront, Singapore. Services include guided waterway tours, corporate day charters, and multi-day team retreats. Service availability is subject to vessel scheduling, weather conditions, and applicable maritime regulations. We reserve the right to modify service descriptions, pricing, or availability at any time prior to a confirmed booking.
4. Bookings and Reservations
All bookings are subject to availability and are not confirmed until you have received a written booking confirmation from us. Submitting an enquiry form or making a payment does not constitute a confirmed reservation until acknowledged in writing by Kelong Tides.
- Bookings may be made via our website enquiry form, email, or telephone
- Corporate and multi-day charters include advance planning calls as part of the process — these are to be scheduled prior to the charter date
- Guest numbers must not exceed the stated capacity for each charter type
- Special requirements (dietary needs, accessibility, equipment) should be communicated at the time of booking
5. Payment Terms
All prices are quoted in Singapore Dollars (SGD) and are inclusive of applicable taxes unless stated otherwise.
- Deposit: A 50% deposit is required to secure a booking date
- Balance: The remaining balance is due 7 calendar days before the charter date
- Multi-Day Retreat: Full payment is required 14 calendar days before departure
- Accepted payment methods will be communicated at the time of booking confirmation
- Late payment may result in forfeiture of the reserved date
6. Cancellation and Rescheduling
We understand that plans change. Our cancellation terms are structured to be as accommodating as possible while reflecting the operational planning involved.
- More than 14 days before charter: Full refund of deposit, or credit toward a rescheduled date
- 8–14 days before charter: 50% of total booking value retained; remainder refunded or credited
- 7 days or fewer: No refund; credit toward a future booking may be offered at our discretion
- Weather cancellation by us: Full credit or refund; we will contact you at the earliest opportunity
- Rescheduling requests are subject to vessel availability and must be made in writing
7. Charter-Specific Terms
Heritage Waterway Tour: Maximum 12 guests. Duration approximately 2 hours. Route follows the Singapore River and inner harbour as conditions permit. Keepsake map and refreshments included.
Corporate Day Charter: Maximum 20 guests. Full-day duration; exact hours confirmed at booking. Route is customisable within southern Singapore waters. AV equipment is provided; the Booking Party is responsible for testing equipment requirements in advance.
Multi-Day Team Retreat: Maximum 10 guests. Three days, two nights. All meals and non-alcoholic beverages included. Guests are expected to participate in advance planning calls scheduled by our events team. Alcoholic beverages may be arranged separately and are not included in the base package price.
In all cases, the master of the vessel retains authority over all safety decisions, including route adjustments or early return to port due to weather or other conditions. Such decisions do not give rise to any refund obligation unless a substantial portion of the charter was unable to proceed.
8. User Responsibilities
The Booking Party accepts responsibility for the conduct of all guests aboard the vessel. Guests are expected to:
- Follow all safety briefings and instructions given by the captain and crew
- Treat the vessel, equipment, and crew with care and respect
- Not bring aboard any prohibited substances or illegal items
- Not exceed the stated guest capacity for the booked charter
- Advise us of any medical conditions or accessibility requirements in advance
The Company reserves the right to refuse boarding or request the disembarkation of any guest whose behaviour poses a risk to safety, the vessel, or other guests. In such cases, no refund shall be due in respect of that individual.
9. Intellectual Property
All content on this website — including text, photography, maps, and design elements — is the property of Kelong Tides Pte. Ltd. or is used under licence. You are granted a limited, non-transferable licence to view website content for personal, non-commercial purposes. Reproduction, distribution, or commercial use of any site content without our written consent is not permitted.
10. Disclaimers
Our services are provided in good faith and with care. However, we make no representations regarding specific outcomes from participation in a charter experience. Marine conditions, weather, and other factors outside our control may affect the experience as described. We are not liable for circumstances arising from force majeure events including but not limited to severe weather, maritime authority restrictions, or unforeseen vessel maintenance requirements.
The website is provided "as is". We do not warrant that the site will be available without interruption or error.
11. Limitation of Liability
To the maximum extent permitted under Singapore law, Kelong Tides Pte. Ltd. shall not be liable for:
- Indirect, consequential, or incidental losses arising from use of the website or services
- Loss of profit, revenue, data, or business opportunity
- Losses arising from circumstances beyond our reasonable control
Our total liability in connection with any charter booking shall not exceed the total amount paid by you for that specific booking. Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded under applicable law.
12. Indemnification
You agree to indemnify and hold harmless Kelong Tides Pte. Ltd., its directors, employees, and agents from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the website or services, or the conduct of you or your guests aboard the vessel.
13. Termination
We may cancel a confirmed booking in exceptional circumstances, in which case we will provide as much notice as possible and offer a full refund or credit. You may cancel a booking in accordance with the terms in Section 6. Either party may terminate an ongoing service arrangement in the event of a material breach that remains uncorrected after reasonable notice.
14. Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Singapore. In the event of a dispute, the parties agree to first attempt resolution through direct discussion in good faith. If the dispute cannot be resolved informally within 30 days, either party may refer the matter to mediation through the Singapore Mediation Centre before commencing legal proceedings. The courts of Singapore shall have non-exclusive jurisdiction over any disputes that proceed to litigation.
15. General Provisions
- Entire Agreement: These Terms, together with your booking confirmation, constitute the entire agreement between the parties in relation to each charter.
- Severability: If any provision is found unenforceable, the remaining provisions continue in full effect.
- Waiver: Failure to enforce any provision does not constitute a waiver of that right.
- Assignment: You may not transfer your booking or obligations under these Terms without our written consent.
- Notices: Formal notices should be sent in writing to our registered address or to [email protected].
16. Changes to These Terms
We may update these Terms from time to time. The revised version will be posted on this page with an updated effective date. For bookings already confirmed, the Terms in force at the time of confirmation shall apply. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
